Proposed Changes to Workers’ Compensation in Arkansas

Arkansas lawmakers are evaluating a proposed bill that could significantly alter the current workers’ compensation system. The legislation, known as S.B. 284, was introduced on Monday and aims to broaden the rights of injured workers when it comes to choosing their healthcare providers and managing legal costs.

Annual Choice of Physician

Under the proposed S.B. 284, injured workers would be granted the opportunity to petition the state Workers’ Compensation Commission for a change in their treating physician once per year. This marks a departure from the current system, where workers are limited to a one-time switch. The new option would allow workers to select either a physician associated with a certified managed care entity or one who adheres to the commission’s rules and fee schedule.

Legal Fees and Independent Medical Examinations

The bill also introduces amendments concerning independent medical examinations. These examinations, to be approved by the commission, would be funded by the employer. Additionally, employers would be required to provide necessary documents to the injured worker. Should the worker decide to depose the medical examiner, they will be responsible for the costs related to witness testimony and court reporting fees.
